When you are stopped at a sobriety checkpoint, or pulled over under the suspicion that you are driving under the influence (DUI), you will most likely be asked to:

  • Submit to breath and blood tests
  • Complete field sobriety tests

If the officer determines that you have been driving drunk, you will be arrested and taken to jail to book you for your crime. Typically, they will confiscate your drivers’ license and you will be issued a temporary one, which will automatically suspend within 30 days. You will have 10 days from your booking date to set up a drivers’ license restoration with the DMV. We do not recommend that clients refuse a breath or blood test as this can automatically suspend your license for up to 1 year.
